Feliks Frankfurter
Feliks Frankfurter (engl. Felix Frankfurter, Beč, Austrougarska, 15. novembar 1882 — Vašington, SAD, 22. februar 1965) je bio američki pravnik koji je služio kao pridruženi sudija Vrhovnog suda Sjedinjenih Američkih Država između 1939. i 1962. Frankfurter je bio i politički aktivan te je pomogao u osnivanju Američkog društva za građanske slobode. Za vreme mandata u Sudu bio je pristalica doktrine „sudijske suzdržanosti“.[2]

U Vrhovni sud ga je imenovao predsednik Frenklin Delano Ruzvelt, nakon smrti sudije Bendžamina N. Kardoza. Frankfurter je bio Ruzveltov prijatelj i savetnik a njegovo imenovanje je jednoglasno potvrđeno u Senatu SAD.[3] Za vreme mandata u Sudu napisao je 247 presuda, 132 izdvojena saglasna mišljenja i 251 nesaglasno mišljenje.[4]
Frankfurter je u Sudu bio najveći zagovornik doktrine „sudijske suzdržanosti“, odnosno smatrao je da Sud ne treba tumačiti Ustav na takav način da postavlja ozbiljna ograničenja zakonodavnoj ili izvršnoj vlasti. Ova njegova filozofija došla je do izražaja u predmetu Školska oblast Minersvil protiv Gobitisa, gde je Frankfurter napisao većinsko mišljenje u kojem je odbačena tvrdnja da primoravanje učenika da izreknu zakletvu zastavi Sjedinjenih Američkih Država i salutiraju zastavi krši Ustav Sjedinjenih Američkih Država, konkretno prvi amandman Ustava. Frankfurter je u presudi napisao da „religijska uverenja ne oslobađaju građane od političkih dužnosti“ i da izuzimanje određene dece od obaveze salutiranja zastavi „može izazvati sumnje kod druge dece“ i smanjiti njihovu lojalnost prema državi. Ova presuda izazvala je seriju nasilnih napada na Jehovine svedoke[5] koji su najčešće odbijali da salutiraju zastavi. Sud je, delimično i zbog nasilne reakcije, samo tri godine kasnije ukinuo sopstvenu presudu u predmetu Odbor za obrazovanje Zapadne Virdžinije protiv Barneta, a Frankfurter je napisao oštro nesaglasno mišljenje.[6][7]
Frankfurter se povukao iz Suda 1962. nakon što je pretrpio moždani udar, a nasledio ga je Artur Goldberg. Umro je od posledica zatajenja srca u 82. godini. Sahranjen je na groblju Mont Obern u Kembridžu u saveznoj državi Masačusets.[8]
